Injunction Relating to Phishing Email Attacks on Virtual Currency Accounts
The plaintiff held a Bitcoin account on a virtual currency trading platform.


The scammers obtained the plaintiff's login information through a phishing email attack and then forged instructions to transfer the Bitcoin to a third-party wallet.
Upon discovery, the plaintiff applied to the Hong Kong court for an emergency injunction prohibiting the transfer of the Bitcoin assets.
 

The plaintiff subsequently successfully obtained a Mareva Order freezing the recipient's assets. The court recognized the use of a constructive trust to recover the transferred assets, marking one of the early cases in Hong Kong recognizing virtual currencies as property and eligible for court protection.
