Upstairs Resident Sues for Noise Nuisance

The resident of the downstairs unit (the plaintiff) sued the resident of the upstairs unit (the defendant) for a nuisance and a violation of the building's deed of mutual covenant due to the constant noise of footsteps, furniture moving, and doors slamming.

After an investigation by the relevant authorities, it was confirmed that the upstairs unit was indeed causing the noise.
 

While the noise was part of everyday life, it also disturbed the peace and tranquility of the downstairs resident.
 

Ultimately, the judge found the downstairs unit liable for nuisance, confirming the violation of the building's deed of mutual covenant and the nuisance. The defendant was ordered to pay the plaintiff HK$50,000 in compensation.
